KCC 825/2001

A case involved a dispute between a claimant and defendants over the payment of her salaries.

A claimant filed a case against defendants requesting that the court order them to pay her salaries.

The court ruled that the second defendant pay the claimant half the value of her comprehensive salary for a certain period.

The claimant and second defendant appealed and the appeal court changed the period applicable.

The claimant appealed by cassation.

Decision

Before the cassation court the claimant argued that the ruling had insufficient evidence of causation as she did not know she had the right to receive her salaries during special leave and that the period of statute of limitations should have been applied from the date she had knowledge of this.

The court held that this argument was invalid as the period of the statute of limitations should be applied from the due date.

The court therefore dismissed the appeal.
