Robbery - Coercion - Pretending to Be a Police Officer
This case involved whether coercion existed in a robbery as the accused had pretended to be a police officer.
Background
The office of public prosecution said in its grounds of appeal that the appealed ruling had erred in the application of law. The office said that the court amended the description of the crime from the one that was penalized by Article 225 of Kuwait Law No. 16/1960 to the one which was penalized by Article 222(2) of Kuwait Law No. 16/1960. The office said that the court dismissed the fact that coercion was used in the robbery though the convicted person pretended that he was a police officer to threaten the victim. The office said moral coercion existed in the crime.
