KCC 780/2001
The initial dispute involved a breached contract. The key issue was whether the Kuwaiti courts had jurisdiction when the defendants were foreigners who were not resident in the country.
Background
A company filed a case against two defendants before the court. The company requested the court to appoint an expert in order to calculate the company's entitlements and to order the defendants to pay them. The company said that it had signed a contract with the defendants in in order to complete two projects but the defendant had failed to commit to their obligations according to the contract and caused them damage.
The court said that the consideration of the case did not fall under its jurisdiction.
The company appealed the ruling before the court of appeal. The court upheld the appealed ruling.
