KCC 772/2010

This case involved whether a council could stop claimants building on land they had received because of compulsory purchase.

Background

The claimants filed a case against a defendant before the court. They requested the court to appoint an expert in order to estimate damage which had resulted from preventing them from building buildings on their land and order the defendant to pay accordingly. They said that the state acquired their land and gave them a different piece of land but they failed to build the building on the new one.

The court ruled that the case was finished.

The claimants appealed the ruling before the court of appeal. The court dismissed the appealed ruling and ruled that an expert should be appointed. The court then ruled that the defendant should pay the claimant 175308 Dinars.

The claimants and the defendant appealed the ruling before the court of appeal. The court upheld the appealed ruling.
