KCC 750/2001
This case involved the validity of investigation and pre-trial procedures in a drugs case.
Background
An appellant said in his grounds of appeal that the appealed ruling by which he was convicted of possessing drugs for taking purposes had erred in the application of law. He said that he had maintained before the court that the inspection proceedings were invalid but the court dismissed this defence.
Decision
The court of cassation said that this argument was invalid. The court said that the court had considered all aspects of the incident and concluded that the elements of the crime existed. The court said that the evaluation of the investigations that preceded the inspection proceedings fell under the court's authority. The court said that the court was satisfied with these investigations. The court said that the inspection proceedings were established on a valid basis including the order issued by the office of public prosecution. The court said that the appellant's defence was irrelevant in this regard.
The court dismissed the appeal.
