KCC 74/2001
Background
An employee filed a case against a company and defendants requesting that the court order them to pay him severance pay.
The court rejected the case against the first defendant due to the statute of limitations and ruled that the second and third defendants pay the employee 1857.073 Dinars.
The defendants appealed and the appeal court abandoned the ruling.
The employee appealed by cassation.
Decision
Before the cassation court the employee argued that the ruling had erred in the application of law as the working contract should have been terminated upon the company's dissolution, however, severance pay should be considered a debt that should be paid.
The court stated that this argument was invalid as the employee's appeal had nothing to do with the appealed ruling and its reasons.
The court therefore dismissed the appeal.
