KCC 704/2000
This case involved the necessary evidence that a college student had committed academic fraud.
Background
A claimant filed a case against defendants before the court. She requested the court to dismiss adecision issued by the third defendant by which she was considered to have “Failed” in all modules for the academic year 1998/1999 due to fraud during exams. She said that the elements of the fraud did not existed in her case.
The court dismissed the case.
The claimant appealed the ruling before the court of appeal. The court dismissed the appealed ruling and ruled that the decision should be dismissed.
The defendants appealed the ruling before the court of cassation. They said in their grounds of appeal that the appealed ruling had erred in the application of law and had insufficient evidence of causation. They said that the court established its ruling on the grounds that the investigations conducted by the dean of the college were invalid though proving fraud in such cases did not entail technical investigation. They said that it was enough for the dean to make sure that fraud had taken place in order to issue his decision.
