KCC 690/2002

The initial dispute involved the dismissal of an administrative decision which had cancelled the rights in a license to exploit government land. A key issue was the validity of the appeal as insufficient reasons were given.

Background

The claimants filed a case against a defendant on his capacity before the court. They requested the court to dismiss an administrative decision issued on 13/10/1997. They said that their father rented a land from the Ministry of Industry and Commerce. They said that then the licence for exploiting the land was cancelled without justification.

The court dismissed the case.

The claimants appealed the ruling before the court of appeal. The court dismissed the appeal and upheld the appealed ruling.

The claimants appealed the ruling before the court of cassation. They said in their grounds of appeal that the appealed ruling had been invalid. They said that they maintained before the court that they had the right in the licence but the court dismissed this defence.
