KCC 672/2001

This case involved whether there was a relationship between the attack on a person and their death.

Background

An appellant claimed that the ruling had charged him with beating another person and causing death. He said in his appeal that the ruling lacked sufficient evidence of causation and had erred in the application of law because he said that there was no causal relation between his action and the death of the victim. The death was caused by the mistake of the doctor. He also added that the statements of the forensic doctor contradicted his report and the statements of the treating doctors. However the court ignored this defence and based its ruling on the said report. He also requested the court to request the opinion of a specialist consultant to examine the causal relationship between the actions and the death of the victim but the court also ignored this request.
