Background

A company filed a case against another company requesting that the court order it to pay an amount of money plus legal interest. The claimant company stated that it had supplied the defendant with raw materials but it had failed to pay for them.

The court ruled that the defendant pay 28432.875 Dinars.

The defendant appealed and the appeal court upheld the ruling.

The defendant appealed by cassation.

Decision

Before the cassation court the defendant argued that the ruling has insufficient evidence of causation as the court had established its ruling on an expert report which the defendant had objected to.

The court held that this argument was invalid as the court had been persuaded by the conclusions of the report and its legal basis.

The court therefore dismissed the appeal.
