KCC 66, 109/2001

This case involved compensation owed to an employee who had been dismissed. The fact the employee had another job was irrelevant to the compensation due. That compensation was detailed in the employment contract and the employee had had the second job before they were dismissed.

Background

An employee made a complaint to the department of labour against a company. He said that he was working for a company and was dismissed from his job without getting paid his entitlements. The department referred the case to the court.

The court ruled that the company should pay the employee 15578 Dinars.

The employee and the company appealed the ruling before the court of appeal. The court dismissed the employee's appeal. The court amended the appealed ruling and ruled that the company should pay the employee 1453 Dinars.

The employee appealed the ruling through an Appeal No. 66 and a previous ruling through Appeal No. 109. The office of public prosecution requested the court to dismiss the first appeal.
