KCC 669/2001

This case involved forgery, robbery and fraud where a credit card had been taken. Key points were the validity of the arrest and investigation proceedings and the assessment of witness evidence.

Background

An appellant said in his grounds of appeal that the appealed ruling by which he was convicted of fabrication, robbery and fraud had erred in the application of law and had insufficient evidence of causation. He said that the court had established its ruling on the grounds of the testimony of the victim though it included many contradictions. He said that he had maintained before the court that the inspection and  arrest proceedings were invalid but the court dismissed this defence.
