Appeal – Landlord – Tenant – Rent – Court – Jurisdiction
This case involved a dispute over the monthly rent for a villa. The landlords attempted to appeal the ruling at the court of cassation. This was illegal as the ruling had been issued by the Court of Appeal Rental department and it was not possible to appeal such rulings in the Court of Cassation.
Background
Some landlords filed a case against tenants and requested the court to increase the rent of a villa to 3500 Dinars per month starting from the date the case was filed.
The tenants filed a case against the landlords and requested the court decrease the rent.
The court rejected the case made by the tenants and ruled that the monthly rent of the villa should be 1950 Dinars starting from the date the case was filed.
The landlords appealed the ruling before the court of appeal. The court upheld the appealed ruling.
The landlords appealed the ruling before the court of cassation.
The Public Prosecution argued the landlords had no right to appeal the ruling.
