This case involved whether the court had been wrong to refuse a request for the victim to be heard as a witness in an indecent assault case where there were contradictions in witness statements.

Background

Two appellants said in their grounds of appeal that the appealed ruling by which they were convicted of indecent assault had erred in the application of law and had violated the right of defence. They said that they requested the court to listen to the testimony of the victim in accordance with Article 163 of Kuwait Law No. 17/1960 but the court dismissed this request. They said that the court established its ruling on the grounds of the testimonies of the witnesses though they included many contradictions.
