Background

The office of public prosecution said in its grounds of appeal that the appealed ruling by which the court had dismissed a penalty against the litigant before considering his appeal had erred in the application of law. The office said that the court of appeal should have suspended the consideration of the office's appeal until the elementary court had settled the appeal made by the litigant through objection.
