KCC 584/2001

This case involved if the court could use contradictory witness evidence to convict an individual of robbery using force and possession of weapons.

Background

An appellant said in his grounds of appeal that the appealed ruling by which he was convicted of robbery by using force and possessing a firearm and ammunition without licence had insufficient evidence of causation. He said that the court established its ruling on the grounds of the testimonies of the prosecution witnesses though they included many contradictions. He said that the court also established its ruling on the grounds of the reasons adopted by the elementary court without providing new reasons.
