This case involved whether the children of a Kuwaiti mother who had been confirmed as being treated as Kuwaiti citizens were also entitled to a Kuwaiti passport.
Background
A claimant filed a case against a defendant before the court. She requested the court to order the defendant to issue passports for her chilren. She said that a previous decision issued by the Minister of Interior ordered the relevant authorities to treat her children as Kuwaiti citizens. She said that the defendant however refused to issue the passports.
The court ruled that the mentioned decision should be dismissed and that the passports should be issued for the children.
The defendant appealed the ruling before the court of appeal. The court upheld the appealed ruling.
Decision
The defendant appealed the ruling before the court of cassation. He said in his grounds of appeal that the appealed ruling had erred in the application of law and had insufficient evidence of causation. He said that the decision made to treat the claimant's children as Kuwaiti citizens did not entail the issue of Kuwait passport for them.
