Background

A claimant filed a case against defendants on their capacities before the court. He requested the court to order the defendants to dismiss a decisions by which cars that did not comply with the relevant standards were imported. He said that these decisions violated Kuwait Ministerial Decision No. 23/1986.

Decision

The claimant appealed the ruling before the court of cassation. He said in his grounds of appeal that the appealed ruling had insufficient evidence of causation and had violated the right of defence. He said that the court refused to dismiss icence No. 1063/1995 on the grounds that this licence had expired. He said that he had maintained before the court that this licence was renewed periodically but the court dismissed this defence.
