KCC 559/2001

This case involved whether there was evidence of kidnapping. A key point was that contradictions in the testimony of the different accused did not lead to the invalidity of the ruling.

Background

An appellant said in his grounds of appeal that the appealed ruling by which he was convicted of kidnapping had insufficient evidence of causation and had erred in the application of law. He said that the court established its ruling on the grounds of the confessions of the second and third convicted persons though these confession contradicted his testimony. He said that he had maintained before the court that the elements of the crime did not exis but the court dismissed this defence
