KCC 556/2001

This case involved when a housing allowance should stop after a council employee sold the related house.

Background

A claimant filed a case against the Kuwait City Council before the court. He requested the court to order the council to dismiss the decision by which he was deprived of a housing allowance.

The court dismissed the case.

The claimant appealed the ruling before the court of appeal. The court dismissed the appealed ruling and ruled that the claimant should receive the housing allowance.

The council appealed the ruling before the court of cassation. The council said in its grounds of appeal that the appealed ruling had erred in the application of law. The council said that the claimant was an employee in the council and that he sold the housing  he got through a loan and therefore the payment of the allowance should stop from the sale date.
