This case involved whether a decision to unfairly confiscate money should be considered an administrative decision.
Background
A claimant made a request to the department of judicial arbitration and requested the defendant to pay amounts of money. He said that the Ministry of Defence had confiscated these amounts without legal justification.
The department said that the consideration of the case did not fall under its jurisdiction.
The claimant appealed the ruling before the court of cassation. He said in his grounds of appeal that the appealed ruling had erred in the application of law and had insufficient evidence of causation. He said that the court had established its ruling on the grounds that the amounts of money were confiscated through an administrative decision and therefore the consideration of the case did not fall under the department's jurisdiction. He said that the documents of the case lacked evidence of the existence of such a decision.
