KCC 533/2001

This case involved the date on which an allowance given to a civil servant for being married should end following his divorce.

Background

A claimant filed a case against a defendant on his capacity before the court. He requested the court to order the defendant to dismiss the decision by which the payment of the social allowance was stopped. He said that he used to receive this allowance because he was married and that the defendant stopped the payment once he got divorced.

The court dismissed the case.

The defendant appealed the ruling before the court of appeal. The court ruled that the decision should be dismissed and that the claimant should receive the social allowance until 26/04/1999.
