Payment of Compensation for Work Injury – Penal Ruling – Obligations – Final Ruling
A case involved a dispute between an employee and a company over the payment of compensation for a work injury.
Background
An employee filed a case against a company requesting that the court order it to pay compensation for a work injury.
The court ruled that the company pay the employee 2666.666 Dinars.
The employee appealed and the appeal court upheld the ruling.
The company appealed by cassation.
Decision
The court of cassation determined a session to consider the case.
The court then stated that the company had filed a penal case against the employee for violating his obligations. The employee had then been accused of a penal crime but the ruling did not become a final one and five years had not passed since the issuance of the ruling.
The court therefore suspended the consideration of the case until the penal case had been dismissed.
