KCC 519/2001

This case involved the employment contract rules which should be applied to an employee who worked for the civil service and whose employment was interrupted by the Iraqi invasion.

Background

A claimant filed a case against some defendants before the court. He requested the court to appoint an expert in order to calculate his financial entitlements and to order the defendants to pay them . He said that he was working for the Ministry of Health and that he was dismissed from his job as a result of the Iraqi invasion of Kuwait. He said that he was then appointed to the same position. He said that he did not get paid his entitlements after the termination of the employment contract.

The court ruled that the first defendant should pay the claimant 2984 Dinars.

The defendants appealed the ruling before the court of appeal. The court dismissed the appeals and upheld the appealed ruling.
