A case involved a dispute between an employee and a company over the payment of his salaries.

Background

An employee filed a case against a company requesting that the court order it to pay his salaries.

The company filed a case against the employee requesting that the court order it to pay an amount of money and the employee requested that the representative of the company swear before the judge but he failed to do so.

The court ruled that the company pay the employee 8895.576 Dinars and rejected the case made by the company.

The company appealed and the appeal court upheld the ruling.

The company appealed by cassation.

Decision

Before the cassation court the company argued that the ruling had erred in the application of law as the court ruled that it had no right to appeal the ruling in respect of wage overtime hours, however, the case documents provided no proof that the employee worked any overtime hours.
