Background

A claimant, as a representative of his sister, filed a case against two defendants and requested the court to order them to pay 15000 Dinars and compensation for the death of his sister's husband.

The court ruled that the first and second defendant should pay the claimant 15000 Dinars.

The first defendant appealed the ruling before the court of appeal and added the third and fourth defendants to the case. The court abandoned the appealed ruling on the compensation for material and moral damage.

Decision

The first defendant appealed the ruling before the court of cassation and stated in his grounds of appeal that the ruling violated the law and stated he had maintained before the court that the case should be dismissed due to the statute of limitations but the court had rejected this argument.
