KCC 475/2001

This case involved a request for the payment of severance pay. It was wrongly argued that a previous ruling had ordered this and so there was a requirement to make the payment. Previous rulings can only bind the parties who are party to them.

Background

A claimant filed a case against two defendants and requested the court to order a decision which deprived him of receiving severance pay.

The court stated the claimant had no right to appeal the decision.

The claimant appealed the ruling before the court of appeal. The court upheld the appealed ruling.

Decision

The claimant appealed the ruling before the court of cassation and stated in his grounds of appeal that the ruling had erred in the application of law and the court had violated the legal power of a previous ruling which had obliged the defendant to pay the mentioned amount and that the claimant fell under the rules of social insurance.
