KCC 43/2002
This case involved a divorce as a result of domestic abuse. A key point was that after the court had appointed two arbitrators for the husband who had both failed to present their reports it was not obliged to appoint a weighted arbitrator.
Background
A wife filed a case against her husband before the court. She said that the husband used to beat her and injured her. She requested the court to order the husband to divorce her.
The court ruled that the wife should get divorced.
The husband appealed the ruling before the court of appeal. The court upheld the appealed ruling.
The husband appealed the ruling before the court of cassation. He said in his grounds of appeal that the appealed ruling had erred in the application of law and had insufficient evidence of causation. He said that he requested the court to delay the consideration of the case though his arbitrator could provide the court with his report but the court dismissed this request. He said that the court had failed to appoint another arbitrator instead.
