KCC 418/2001

The original dispute involved a woman who had not received her share of rent from properties she had inherited from her husband. Key issues included the validity of the expert report and if the correct procedures had been used for a sub-request for a final clearance.

Background

A claimant filed a case against defendants before the court. She requested the court to appoint an expert in order to calculate her share in the rent of two properties owned by her husband and to pay her the amount which resulted accordingly. She said that she had inherited a share in these two properties from her husband and that the defendants seized the properties and failed to pay her shares.

The court appointed an expert and then ruled that the defendants should pay the claimant 13157 Dinars.

The defendants appealed the ruling before the court of appeal. The court upheld the appealed ruling.
