KCC 416/2002

This case involved whether a preventative detention order should be made against a company's assets when the company had admitted it owed the money, their was no dispute and had offered to pay it.

Background

A company filed a case against a company before the court. The company asked the court to dismissed an appealed order and impose a preventive detention on the accounts and the amounts of money the company owed to the relevant party. The company said that it had completed a project for the company and that they still owed an amount of money as a result.

The court ruled that the appealed order should be dismissed. The court determined the company's debt at 700000 Dinars and ruled that the preventive detention should be imposed on the company's assets.

The company appealed the ruling before the court of appeal. The court dismissed the appealed ruling and upheld the appealed order.
