An employee filed a case against a ministry and a company before the court. He requested the court to order the ministry to accept his request to transfer his sponsorship to another company.

The court ruled that the employee should get the approval to move to another sponsor.

The ministry and the company appealed the ruling before the court of appeal. The court upheld the appealed ruling.

The ministry appealed the ruling before the court of cassation. The ministry said in its grounds of appeal that the appealed ruling had erred in the application of law. The ministry said that the court established its ruling on the grounds that the company misused its authority though the ministry had the right to consider the transfer request in accordance with Kuwait Ministerial Decision No. 106/1994.
