KCC 40/1996

The initial dispute involved an employee who had lost his job due to the Iraqi invasion and had not received his entitlements. The key point was whether the notification procedures had been fulfilled as a representative of the company was at the hearing.

Background

An employee made a complaint to the department of labour against a company. He said that he was working for the company and he lost his job as a result of the Iraqi invasion of Kuwait in 1990. He said that the company had failed to pay his entitlements. The department referred the case to the court.

The court ruled that the company should pay the employee 7500 Dinars.

The company appealed the ruling before the court of appeal. The court dismissed the appealed ruling due to the invalidity of proceedings.
