Background
A claimant filed a case against defendants requesting that the court suspend the implementation of a decision until an expert had provided his report. The claimant requested that the court appoint an expert to calculate the debt the defendants owed to him.
The court rejected the case.
The claimant appealed and the appeal court rejected the case for being previously settled.
The claimant appealed by cassation.
Decision
Before the cassation court the claimant argued that the ruling had erred in the application of law as the law prevents banks from collecting interest which exceeds the legal rate.
The court held that the lower courts had ruled that the case had been settled in compliance with the law.
The court therefore dismissed the appeal.
