KCC 380/2001

The original dispute involved compensation from a council for the seizure of property. This case involved whether a case to appoint an expert would interrupt the period for the statute of limitations.

Background

A claimant filed a case against the Council of Kuwait before the court. He requested the court to order the council to pay him 776710 Dinars as compensation. He said that the council had illegally sized his property.

The court ruled that the council should pay the claimant the amount.

The council appealed the ruling before the court of appeal. The court upheld the appealed ruling.

The council appealed the ruling before the court of cassation. The council said in its grounds of appeal that the appealed ruling had erred in the application of law. The council said it maintained before the court that the case should be dismissed due to the statute of limitations because the claimant filed the case 15 years after the seizure of the property but the court dismissed this defence. The council said that the court established its ruling on the grounds that the claimant had filed a previous case and therefore the period of limitation was interrupted.
