KCC 338/2001

This case involved if a divorced man who had arranged housing for his daughter also had to pay her expenses.

Background

A woman filed a case against her husband before the court. She requested the court to order the husband to pay expenses for her daughter and the wages of a servant.

The court ruled that the husband should pay the expenses.

The husband appealed the ruling before the court of appeal. The court dismissed the appealed ruling on the payment of the servant wages and upheld the appealed ruling otherwise.

The husband appealed the ruling before the court of cassation. He said in his grounds of appeal that the appealed ruling had insufficient evidence of causation. He said that the court ordered him to pay the daughter's expenses although he had prepared suitable housing for the daughter and therefore he should not pay the expenses

Decision

The court said that this argument was valid. The court said that the documents of the case revealed that the expert report confirmed that the husband had prepared suitable housing for his daughter. The court said that the husband was therefore not obliged to pay the expenses of his daughter.
