KCC 335/2001

This case involved a divorced man's request for custody of his children and not to pay maintenance for them on the grounds they were above the age of custody. A key question was whether this case had been previously decided.

Background

A claimant filed a case against a divorced woman before the court. He requested the court to dismiss the woman's custody of his children and dismiss the payment of expenses he used to pay to these children. He said that he used to be married to the woman and that the children's age exceeded the custody age.

The court ruled that the woman's custody of the children should be dismissed and that the husband should not pay their expenses. The court ruled that the children should be added to the claimant's custody.

The woman appealed the ruling before the court of appeal. The court upheld the appealed ruling.
