KCC 32/2002

A case involved a dispute between an employee and a company over the payment of allowances and promotion.

Decision

Before the cassation court the employee argued that the ruling had erred in the application of law and had insufficient evidence of causation as his employment responsibilities had increased and he had been given the required training, however, his salary remained less than that of his colleagues who had been appointed in the same year. The court expert had also concluded that he deserved the mentioned allowances.

The court held that this argument was invalid as the qualifications of the employee were different to those of his colleagues. The court stated that the determination of allowances fell under the authority of the employer.

The court therefore dismissed the appeal.
