KCC 322/2001

This case involved a branch manager who had seized money from a company, A key point was whether the court had the right to correct mistakes in a ruling when the amount ordered as compensation differed from a previous ruling.

Background

A company filed a case against a defendant before the court. The company requested the court to order the defendant to pay 5001 Dinars as compensation. The company said that the defendant used to work as a manager of a branch in the company and that she seized an amount of money from its revenues.

The court ruled that the defendant should pay the amount.

The defendant appealed the ruling before the court of appeal. The court upheld the appealed ruling.

The defendant appealed the ruling before the court of cassation. She said in her grounds of appeal that the appealed ruling had erred in the application of law and had insufficient evidence of causation. She said that a previous ruling issued by the case ordered her to pay 500 Dinars as compensation and that the company appealed the ruling at the time and the court confirmed that she should pay 500 Dinars only.
