KCC 316/2001

This case involved whether correct arrest procedures had been followed in a drugs case. The court had the authority to decide this. There was authorisation from the office of public prosecution and witness evidence.

Background

An appellant said in his grounds of appeal that the appealed ruling by which he was convicted of possessing drugs for taking purposes had insufficient evidence of causation. He said that he maintained before the court that the arrest proceedings were invalid because they were not established on the grounds of serious investigations but the court dismissed this defence.
