KCC 299/2001

This case involved whether a woman should get a divorce from her husband because he beat and insulted her. The husband had argued the dispute did not require a divorce.

Background

A wife filed a case against her husband before the court. She requested the court to divorce her from her husband. She said that her husband used to beat and insult her in a way that makes living with him impossible.

The court dismissed the case.

The wife appealed the ruling before the court of appeal. The court dismissed the appealed ruling and ruled that the wife should be divorced.

The husband appealed the ruling before the court of cassation. He said in his grounds of appeal that the appealed ruling had erred in the application of law and had insufficient evidence of causation. He said that the dispute between the two parties should not entail a divorce.
