Background
A claimant filed a case against a defendant and requested the court to order the defendant to pay him blood money of 10000 Dinars and compensation of 5000 Dinars for the death of his father as a result of an assault.
The court ruled that the defendant should pay the claimant blood money of 10000 Dinars.
The claimants and the defendant appealed the ruling before the court of appeal. The court upheld the appealed ruling.
Decision
The defendant appealed the ruling before the court of cassation and stated in his grounds of appeal that the ruling had erred in the application of law and stated that the claimant's father had been killed at work and so Article 61/1 of the Labour Law should be applied over his case.
