This case involved whether it was possible to appeal a final ruling of the elementary court on the entitlements of an employee who was terminated.
Background
An employee made a complaint to the department of labour against a company. He requested the company to pay him his entitlements for the period from 01/04/2000 to 01/07/2000 in addition to severance pay and the remaining value of the contract. The department referred the case to the court.
The court ruled that the company should pay the employee 3406 Dinars.
The company appealed the ruling before the court of appeal. The court dismissed the appealed ruling and dismissed the case.
The employee appealed the ruling before the court of cassation. He said in his grounds of appeal that the appealed ruling had erred in the application of law. He said that the court dismissed the appealed ruling without legal justification. He said that the company had maintained before the court that the elementary court failed to consider a settlement reached between the two parties though the the court had considered all the documents of the case properly.
