This case involved the validity of an appeal when reasons were not given and the lawyer lacked authorisation to represent the defendant before the court of cassation.

Decision

The court of cassation considered the issues which related to the public order. The court said that the documents of the case revealed that the appellant's lawyer had received an authorization from the appellant's father  to defend the appellant before the court. The court said that the documents of the case revealed that the authorization does not permit the lawyer to defend the appellant before the court of cassation. The court said that the appellant's lawyer had failed to provide the reasons of the appeal within the legal deadline stipulated by Article 9 of Kuwait Law No. 40/1972.

The court dismissed the appeal.
