An employee filed a case against a company requesting that the court order the company to pay his salaries.

The court ruled that the company pay the employee 6204.656 Dinars.

The company appealed and the appeal court ruled that the company pay the employee 4844.656 Dinars.

The company appealed by cassation.

Decision

Before the cassation court, the company argued that the ruling had erred in the application of law as the court had requested that the company's representative swear before a judge, however, the company had provided the court with a settlement in which the employee endorsed receiving all his dues.

The court stated that this argument was valid as the court should not request the disputed parties to swear before a judge unless the issues are subjective.

The court therefore repealed the ruling.
