This case involved the compulsory purchase of properties by the council. A key issue was whether the individual had lost their rights as they had not taken steps against the council at the time.

Background

A claimant filed a case against two defendants before the court. He requested the court to appoint an expert in order check the status of the disputed properties and to determine the date in which the local council had seized them and to estimate the value of compensation. He said that a previous ruling had validated his ownership of these properties and that the council had illegally seized them.

The court ruled that the first defendant should pay the claimant 1282050 Dinars.

The first defendant appealed the ruling before the court of appeal. The court amended the appealed ruling and ruled that the first defendant should pay the claimant 1211000 Dinars.
