KCC 223/2001

This drugs case involved the validity of arrest and investigation proceedings. These were valid as approval had been received from the public prosecution.

Background

An appellant said in his grounds of appeal that the appealed ruling by which he was convicted of possessing drugs had erred in the application of law and had insufficient evidence of causation. He said that he had maintained before the court that the inspection and the arrest proceedings were invalid because they were not preceded by serious investigations but the court dismissed this defence. He said that the material element of the crime did not exist in his case.
