Background

The claimants appealed the ruling before the court of appeal. The court abandoned the appealed ruling and ruled the company should pay the claimants 16438.588 Dinars.
Decision
The company appealed the ruling before the court of cassation and stated in its grounds of appeal that the ruling had violated the right of defence because the court had ignored its request for delaying the consideration of the case in order to defend its claims and reserved the appeal from the first session.
The court stated this argument was invalid because the court was not obliged to fulfil a request made by the disputed parties to delay the consideration of the case.
