KCC 204/2001
The initial dispute involved a property sale where the claimant had been given authorisation to sell the property but the defendants had not taken steps to register the contract. A key point was whether the rules of a law which had not come into force at the time the contract was signed governed the dispute.
Background
A claimant filed a case against defendants before the court. He requested the court to validate a sales contract dated on 21/04/1976 regarding a property. He said that the first defendant owned the disputed property and that the fifth defendant received an authorization to sell the property and he sold it. He said that the defendants had failed to complete the proceedings for registering the contract.
The court rejected the case.
The claimant appealed the ruling before the court of appeal. The court dismissed the appeal.
