Payment of Salaries – Loan – Severance Pay – Kuwait Labour Law – Company Statute
A case involved a dispute between an employee and a company over the payment of his salaries.
Background
An employee filed a case against a company requesting that the court order it to pay his salaries.
The company filed a case against the employee requesting that the court order it to pay the remaining value of a loan it had received by way of the company's guarantee.
The court ruled that the company pay the employee 3758.647 Dinars and rejected the case made by the company.
The employee and company appealed and the appeal court upheld the ruling.
The employee appealed by cassation.
Decision
Before the cassation court the employee argued that the ruling had violated the law as the court ruled that the company pay half the value of severance pay in violation to the company's statute.
