Evidence – Fund – Dues – Members – Employment
This case involved a request for an expert to be appointed to calculate an individual's dues in a syndicate fund. There were contradictions in the evidence as the calculation should have been made based on the number of members in the fund when the individual left employment. Evidence of the number was provided but the court wrongly used an estimate of this number.
Background
A claimant filed a case against a defendant and requested the court to appoint an expert in to calculate his dues in a syndicate fund of an Oil Company and order the defendant to pay him accordingly.
The court appointed an expert and then ruled the defendant should pay the claimant his dues.
The defendant appealed the ruling before the court of appeal. The court changed the appealed ruling and ruled that the defendant should pay the claimant 2731.809 Dinars.
